courtmartialdefenselawyer364The commander has a wide range of responses available to him and should use the one that will achieve a result that is warranted, appropriate, and fair. Counseling the Soldiers concerned is usually the most appropriate initial action, particularly when only the potential for an appearance of actual preference or partiality, or an appearance without any adverse impact on morale, discipline or authority exists.

  • Adverse Administrative Actions: Order to terminate, relief, re-assign, bar to re- enlistment, reprimand, adverse OER/NCOER, administrative separation.
  • Criminal Sanctions: Fraternization, disobey lawful order, conduct unbecoming, adultery.
