- One reason there was a jurisdictional gap prior to MEJA was that the definition of “special maritime and territorial jurisdiction of the United States,” (SMTJ) was interpreted as excluding U.S. military installations overseas.
See United States v. Gatlin, 216 F. 3d 207 (2d Cir. 2000). In 2001, the Patriot Act amended the definition to include military installations overseas, however the definition excludes anyone already covered by the MEJA. See 18 U.S.C. § 7.
