Mixed plea cases
- The military judge should ordinarily defer informing the members of the offenses to which the accused pled guilty until after the findings on the remaining contested offenses have been entered. R.C.M. 913(a).
- Exceptions to this rule include when the accused requests otherwise, and when the accused’s plea was to lesser-included-offense and the prosecution intends to prove the greater offense. See R.C.M. 913(a) discussion.
